Terms of sale

These terms apply to every product you buy from Travertina. Please read them before you order. By placing an order, you accept them.

They are written in English, and English is the language of our contract with you.

1. Who we are, and how to reach us

Travertina is a trading name of Adrien Cluzel.

Customer service is open every day, 8am to 5pm UK time, in English.

We sell to consumers buying for their own use. We may decline orders for quantities that plainly exceed personal use, including orders for more than six identical items. If you are buying for a business or for a project, please contact us before ordering, as different terms will apply.

If we need to contact you, we will do so by email or telephone using the details you gave us when ordering. Please make sure they are correct.

2. The products

We sell ceiling lights, pendant lights and wall lights made from travertine, for domestic indoor use unless a product page states otherwise.

The main characteristics of each product, including specifications, images and dimensions, are set out on its product page. Please read them before ordering.

Travertine is a natural stone. Variation in tone, veining, porosity and surface marking from one piece to another is a characteristic of the material, not a fault. Our photographs are as faithful as we can make them, but your screen settings will also affect how colours appear. If the piece you receive differs materially from what was described, that is a different matter and section 9 applies.

Stock is limited to what is shown at the time you order.

3. How a contract is formed

You place an order on the site. Your order is an offer to buy from us.

We send you an email acknowledging the order. This is not acceptance. It confirms we have received your order and nothing more.

The contract between us comes into existence when we email you to confirm that your order has been dispatched. If we cannot accept your order, we will tell you and will not charge you, or will refund you in full within 14 days.

We may be unable to accept an order because a product is out of stock, because we have identified an error in the price or description, because we cannot authorise your payment, because there is an unresolved dispute over a previous order, or because we do not deliver to your address.

Before you confirm your order you can review it in full, check the total price, and correct any mistake. Please check it carefully.

You can follow the progress of your order on the site.

Unless proven otherwise, our records are evidence of the orders placed with us.

Changing or cancelling before dispatch

To change an order, email contact@travertina.co.uk at least one working day before the expected dispatch date. We will accommodate the change if we can. If we cannot, and you no longer want the order, we refund you in full within 14 days.

You can cancel an order at no cost at any time before it is dispatched, by emailing contact@travertina.co.uk. We refund you in full within 14 days.

Your separate right to cancel after delivery is set out in section 8.

4. Prices, VAT and duties

Prices are those shown on the site when you place your order, in pounds sterling.

The price you see is the price you pay. It includes UK VAT, all customs duties and import charges, and all handling, packing and delivery costs. There is nothing to pay on delivery, and you will never receive a separate demand from a carrier.

We may change our prices at any time, but your order is charged at the price displayed when you placed it.

If a price is wrong

We take care to price our products correctly, but errors happen. If we discover an error in the price of your order before we accept it, we will tell you and ask whether you wish to continue at the correct price or cancel. If you cancel, or if we cannot reach you, we refund you in full within 14 days.

If a pricing error is obvious and could reasonably have been recognised as an error, we are not obliged to supply at the incorrect price.

5. Payment

Payment is taken in full when you place your order, by secure payment, using:

  • credit or debit card, including Visa, Mastercard and American Express
  • Apple Pay
  • PayPal
  • Klarna

The methods actually available to you are shown at checkout.

Payment data is handled by providers certified to the PCI-DSS standard. We never have access to your full card number.

If your card is used fraudulently, you may ask for the payment to be cancelled and the money returned, in line with your card issuer's rules.

6. Delivery

We deliver to addresses in Great Britain: England, Scotland and Wales. We do not currently deliver to Northern Ireland, the Channel Islands or the Isle of Man.

Delivery takes 4 to 8 working days from the day your order is processed. This covers both preparation and transit. Orders placed after 2pm UK time are processed the next working day. Working days are Monday to Friday, excluding public holidays. The estimated delivery date is shown on the product page and at checkout.

Delivery is complete when the goods are handed to you at the address you gave us. Unless an item is unavailable, we deliver your order in one consignment.

If we are late

If we do not deliver by the date we gave, or in any event within 30 days of the contract being formed, you may set a further reasonable period and ask us to deliver within it. If we still do not deliver, you may end the contract and we will refund you in full within 14 days.

You may end the contract immediately, without setting a further period, if we refuse to deliver, if delivery by a specific date was essential and you told us so before ordering, or if it was obvious from the circumstances that the date was essential.

If nobody is in

The carrier will leave a card and attempt redelivery or hold the parcel locally. If an order comes back to us undelivered after reasonable attempts, we will contact you to arrange a further delivery.

If we cannot deliver after that further attempt, we may end the contract and refund you the price of the goods. We may deduct the direct cost of the failed delivery attempts, which we will tell you before we process the refund. We do not make this deduction where the failure was our fault or the carrier's, and it does not apply where you are cancelling under section 8.

7. Ownership and risk

The goods remain ours until we have received payment in full.

The goods are at our risk until you take physical possession of them. If your order is lost, stolen or damaged in transit, that is our responsibility, and we replace it or refund you in full at no cost to you. There is no separate cover to buy.

If you ask the carrier to leave your parcel in a safe place, with a neighbour or at a collection point, the order becomes your responsibility from the moment it is left there as you asked.

8. Cancelling because you changed your mind

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may cancel at any time from the moment you place your order until 14 days after the day you, or someone you nominate, receives it. You do not need to give a reason.

If your order arrives in several deliveries, the 14 days run from the day you receive the last item.

How to cancel. Email contact@travertina.co.uk, or use the cancellation form at the end of these terms. Any clear statement will do. We will acknowledge your cancellation on a durable medium.

Sending the goods back. You then have 14 days to send the goods back. Please return them complete, with all fittings, fixings and the printed instructions, in the original packaging where you still have it. We do not make any deduction simply because the box has been opened or discarded.

Handling. You may handle the goods as you would in a shop, enough to establish their nature, characteristics and how they work. If you go beyond that and the value of the goods is reduced, we may deduct that reduction from your refund. Fitting a light to a wall or ceiling, drilling the backplate or wiring it in goes beyond inspection. We will always tell you the amount and the reason before we process the refund.

Who pays for the return. You pay the cost of returning the goods when you are cancelling because you changed your mind. Our returns address is in France, and return postage from the United Kingdom typically costs between £25 and £45. We recommend a tracked service, as the goods are your responsibility until they reach us. You do not pay return postage if the goods are faulty, damaged, incorrect or not as described.

Your refund. We refund everything you paid, including the standard delivery charge on the original order, within 14 days of receiving the goods back or of the day you give us proof of posting, whichever is earlier. The refund goes to the payment method you used, unless you agree otherwise. We charge no restocking or administration fee.

Goods you cannot cancel. The cancellation right does not apply to goods made to your specification or clearly personalised. Where that applies, it is stated on the product page before you buy.

9. If something is wrong with your order

Your rights here are given by the Consumer Rights Act 2015. They are separate from, and additional to, your right to change your mind under section 8.

Goods we supply must be of satisfactory quality, fit for purpose and as described.

When the problem appears What you can ask for
Within 30 days of delivery Reject the goods and receive a full refund. You do not have to accept a repair or replacement first. This is your short-term right to reject.
After 30 days A repair or a replacement, carried out within a reasonable time and without significant inconvenience to you.
If a repair or replacement fails, or is not possible A price reduction, or you may reject the goods for a refund. After the first six months, we may reduce the refund to reflect the use you have had.

The first six months. If a fault appears within six months of delivery, it is taken to have been present at delivery unless we can show otherwise. You do not have to prove anything.

Time limits. You can bring a claim under the Consumer Rights Act for up to six years from delivery in England and Wales, and five years from the date you became aware of the problem in Scotland. This does not mean products are guaranteed for that period; it is the period in which a claim can be brought.

How to claim. Email contact@travertina.co.uk, with photographs of the problem where you can. Photographs are not a condition of your rights, but they help us resolve things faster.

Costs. We pay the cost of returning any faulty, damaged, incorrect or misdescribed item, and will arrange collection or send a prepaid label. Refunds are made to your original payment method within 14 days.

When these rights do not apply. They do not cover damage caused by misuse, neglect, lack of maintenance, accident, normal wear, or use of the product for business purposes. They also do not cover damage caused by incorrect installation. See section 10.

10. Installation, safety and compliance

Our fixtures are mains-powered and must be installed by a qualified electrician. In some cases, notably bathrooms, installation is also subject to building regulations. Please do not attempt to wire a fixture yourself.

We supply appropriate fixings with every product, along with printed instructions in English. Please check that the fixings supplied are suitable for your wall or ceiling construction, and ask your electrician if you are unsure. Travertine is heavy, and the weight of each fixture is stated on its product page.

Damage caused by incorrect installation, by fixings other than those supplied, or by fitting a product to a surface it is not suited to, is not a manufacturing fault. This does not affect your rights in respect of a product that was faulty when it reached you.

Our products meet the applicable UK requirements for electrical equipment, including the Electrical Equipment (Safety) Regulations 2016, and carry the relevant conformity marking.

11. Disposing of electrical equipment

Electrical products must not be thrown away with household waste. The crossed-out wheeled bin symbol means an item has to be collected separately so that its materials can be recovered.

You can take household electrical waste to your local authority recycling centre free of charge. Recycle Your Electricals (recycleyourelectricals.org.uk) will find your nearest point from your postcode.

12. Our liability to you

Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • defective products, under the Consumer Protection Act 1987
  • your rights under the Consumer Rights Act 2015 that goods be of satisfactory quality, fit for purpose and as described
  • any other matter for which it would be unlawful to exclude or limit liability

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that failure. We are not responsible for loss or damage that was not foreseeable.

We supply our products for domestic and private use. We are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.

If you take a product outside the United Kingdom, it is your responsibility to check that it may lawfully be used there.

13. Events outside our control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event outside our reasonable control. Such events include fire, flood, extreme weather, natural disaster, epidemic, industrial action, civil unrest, acts of terrorism, the acts of government, failure of public or private telecommunications networks, and the failure or disruption of carriers or delivery networks.

If such an event occurs, we will tell you as soon as we reasonably can and take reasonable steps to limit its effect. Where it affects an order, we will agree a new delivery date with you.

If the delay becomes significant, you may cancel the order and we will refund you in full, including any sums already paid. You do not need to wait for the event to end before doing so.

Nothing in this section affects your statutory rights, including your right to a refund where we fail to deliver within the time agreed or, if no time was agreed, within 30 days.

14. Your personal data

We use your personal data to process your order, issue invoices and manage our relationship with you, and we share it with the suppliers who help us do that. Full details, including retention periods and your rights, are in our Privacy Policy.

15. Intellectual property

The content of our site, including text, photographs, illustrations, dimension diagrams and the Travertina name, belongs to us or is used under licence, and is protected by copyright and trade mark law. Reproduction without our written permission is prohibited.

16. Complaints and disputes

Please email us first at contact@travertina.co.uk. We aim to reply within two working days, and we would much rather resolve a problem directly.

Travertina does not currently subscribe to an alternative dispute resolution scheme, and is not obliged to do so. If we cannot resolve your complaint between us, we will write to you confirming this, and we will give you the name and website of an approved ADR provider competent to consider your case, along with our position on using it.

You can also get free, impartial advice from the Citizens Advice consumer service at citizensadvice.org.uk, or bring a claim through the small claims track of the county court.

17. Other important terms

Transfer. We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens, and it will not affect your rights.

Severability. If any provision is held unlawful, void or unenforceable, the remaining provisions continue to apply.

No waiver. If we do not insist that you do something you must do under these terms, or delay in taking action against you, that does not prevent us from doing so later.

Third parties. These terms are between you and us. No one else may enforce them under the Contracts (Rights of Third Parties) Act 1999.

Changes to these terms. We may change these terms. The version that applies to your purchase is the one published when you placed your order.

Other documents. Our Terms of Use, Privacy Policy, Returns and Refunds policy and Shipping policy also apply. Where they differ from these Terms of Sale on anything relating to a sale, these Terms of Sale take precedence. This does not affect the information we gave you before you placed your order, which forms part of your contract with us.

18. Governing law and jurisdiction

These terms are governed by the law of England and Wales.

This does not deprive you of the protection given to you by the mandatory consumer law of the country where you live. If you live in the United Kingdom, the protections given to you by UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, apply in full.

You may bring proceedings in the courts of the part of the United Kingdom where you live. We will bring proceedings against you only in those courts.
