Overview

This website is operated by Adrien Cluzel, trading as Travertina. On this site, "we", "us" and "our" refer to Adrien Cluzel.

These Terms of Use govern your access to and use of travertina.co.uk, together with the information, tools and content available on it.

Sales of products made through this site are governed by our Terms of Sale, which are available on this site. Where these Terms of Use and the Terms of Sale differ on anything relating to sales, orders, prices, delivery, cancellation or guarantees, the Terms of Sale take precedence.

By accessing or using this site, you agree to be bound by these Terms of Use. If you do not agree to them, please do not use the site.

Any new features added to the site later are also covered by these Terms of Use. You can read the current version on this page at any time.

Our shop is hosted by Shopify Inc., which provides the e-commerce platform through which we sell our products.

1. Using this site

You may browse this site freely. To place an order, you must be at least 18
years old and able to enter into a legally binding contract. If you are under
18, you may use the site with the permission of a parent or guardian, but any
order must be placed by them.

This concerns your capacity to enter into a contract with us. Separate rules
govern consent to the processing of personal data, and these are explained in
section 9 of our Privacy Policy.

Section 7 sets out how you must not use the site. If you breach these Terms of
Use, we may suspend or withdraw your access. This has no effect on orders you
have already placed, which remain governed by the Terms of Sale.

2. General

We may refuse access to the site to anyone, where we have a proper reason for doing so.

Traffic between your browser and the site is encrypted using TLS. Payment data is handled by providers certified to the PCI-DSS standard and is never transmitted in the clear.

You must not reproduce, duplicate, copy, sell, resell or exploit any part of the site without our prior written permission.

The headings used in these terms are for convenience only and do not affect how the terms are interpreted.

3. Editorial content

Editorial content on the site, including articles, installation advice, inspiration and guides, is provided for general information. We work to keep it accurate and current, but we do not warrant that it is complete or up to date at all times, and it is not professional advice. Electrical installation advice in particular is general in nature and does not replace the judgement of a qualified electrician.

This does not apply to the main characteristics, prices, availability and sale conditions of our products, which bind us as set out in the Terms of Sale and under the Consumer Rights Act 2015.

We may change editorial content at any time.

4. The site and our prices

Prices may change at any time.

An order you have placed is charged at the price displayed when you placed it. A later price change has no effect on orders already made. How a contract is formed, and what happens if a price is displayed in error, is set out in the Terms of Sale.

We may change, suspend or withdraw all or part of the site, including for maintenance. We will give notice where we reasonably can, but the site is made available free of charge and we do not guarantee that it will always be available or uninterrupted.

5. Products shown on the site

Some products are available in limited quantities.

We work to show the colours and appearance of our products as faithfully as we can. Travertine is a natural stone, and variation in tone, veining and porosity from one piece to another is a characteristic of the material rather than a defect. Your screen settings may also affect how colours appear.

We may limit order quantities, discontinue a product, or limit sales to particular geographic areas.

Returns, refunds and your rights in respect of faulty goods are set out in our Returns and Refunds policy and in the Terms of Sale.

6. Errors and inaccuracies

The site may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions or availability.

We may correct any error at any time. Where an obvious pricing error affects an order you have already placed, we will tell you without delay, and the position is set out in the Terms of Sale.

7. Prohibited uses

You must not use the site or its content:

  • for any unlawful purpose
  • to encourage others to carry out or take part in any unlawful act
  • to breach any applicable law or regulation
  • to infringe our intellectual property rights or those of anyone else
  • to harass, abuse, defame, intimidate or discriminate against anyone,
      including on the grounds of any protected characteristic under the Equality
      Act 2010
  • to submit false or misleading information
  • to transmit viruses or any other malicious code
  • to collect or track the personal data of others
  • to send unsolicited messages, to phish, or to scrape the site by automated means
  • for any obscene purpose
  • to interfere with or circumvent the security features of the site
  • to attempt to gain unauthorised access to the site, the server on which it
      is stored, or any connected server, computer or database

We may suspend or withdraw your access to the site if you breach any of these.
This has no effect on orders you have already placed, which remain governed by
the Terms of Sale.

8. Intellectual property

All content on this site, including text, photographs, illustrations, dimension diagrams, logos and the Travertina name, belongs to us or is used under licence. It is protected by copyright, trade mark and other intellectual property laws.

You may view, download and print pages from the site for your own personal use, or to share with a tradesperson working on your home. You must not use any part of the site for commercial purposes without our written permission, and you must not alter our content or remove any copyright notice.

9. Reviews, comments and other content you submit

If you send us reviews, comments, ideas or suggestions, you give us permission to reproduce, publish, adapt and translate them on our own channels, free of charge.

You may ask us to remove a contribution of yours at any time by emailing contact@travertina.co.uk. We will do so within a reasonable time, and this permission ends when we do.

We are not obliged to keep your comments confidential, and we are not obliged to reply to them.

We may, but need not, moderate or remove any content we consider unlawful, offensive, threatening, abusive, defamatory, obscene, or in breach of anyone's rights.

You confirm that your contributions do not infringe anyone's rights, including copyright, trade marks, privacy or image rights, and that they contain nothing unlawful and no malicious code. You must not use a false email address or impersonate anyone. You are responsible for what you post.

10. Optional third party tools

We may give you access to third party tools that we neither control nor monitor.

These are provided as they are, without any warranty from us. If you use them, please read the terms offered by the provider concerned.

11. Links to other sites

The site may contain links to third party websites that are not connected with us.

We do not control the content of those sites and are not responsible for the products, services or content offered on them. Please read their own terms and policies.

Complaints about a third party's products or services should be taken up with them directly.

12. Your personal data

How we handle your personal data is set out in our Privacy Policy, available on this site.

13. Our liability to you

Nothing in these Terms of Use limits or excludes our liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • any matter for which it would be unlawful to exclude or limit liability
  • your statutory rights in respect of the products we sell you, including your rights under the Consumer Rights Act 2015 that goods be of satisfactory quality, fit for purpose and as described
  • defective products, under the Consumer Protection Act 1987

Subject to that:

We do not guarantee that access to the site will be uninterrupted, error free, or free from technical fault. The site may be unavailable from time to time, including for maintenance.

We are not liable for loss or damage arising from the site being unavailable, from a failure of the internet, or from your use of unsuitable equipment or an unsuitable browser.

We are not liable for any loss that was not foreseeable at the time you started using the site, nor for loss connected with a business, including loss of profit, loss of business or loss of business opportunity. The site is provided for domestic and private use.

These limits concern the site and how it works. They do not apply to the products we sell you, or to our obligations to you as a consumer, which are set out in the Terms of Sale and in our Returns and Refunds policy, and which apply in full.

14. Events outside our control

We are not liable for any failure or delay in performing our obligations where
that failure or delay results from an event outside our reasonable control.
Such events include fire, flood, extreme weather, natural disaster, epidemic,
industrial action, civil unrest, acts of terrorism, the acts of government,
failure of public or private telecommunications networks, and the failure or
disruption of carriers or delivery networks.

If such an event occurs, we will tell you as soon as we reasonably can and take
reasonable steps to limit its effect. Where it affects an order, we will agree
a new delivery date with you.

If the delay becomes significant, you may cancel the order and we will refund
you in full, including any sums already paid. You do not need to wait for the
event to end before doing so.

Nothing in this section affects your statutory rights, including your right to
a refund where we fail to deliver within the time agreed or, if no time was
agreed, within 30 days.

15. If you have a complaint

Please email us at contact@travertina.co.uk. We aim to reply within two working days.

Travertina does not currently subscribe to an alternative dispute resolution scheme, and is not obliged to do so. If we cannot resolve your complaint between us, we will write to you confirming this, and we will give you the name and website of an approved ADR provider competent to consider your case, along with our position on using it.

You can also get free, impartial advice from the Citizens Advice consumer service at citizensadvice.org.uk.

16. Other important terms

Severability. If any provision of these Terms of Use is held to be unlawful, void or unenforceable, it is treated as separate from the rest, and the remaining provisions continue to apply.

No waiver. If we do not enforce a right under these terms, that is not a waiver of that right.

Duration. These Terms of Use apply for as long as you use the site. You may stop using the site at any time. Obligations arising before you stop, including in relation to orders already placed, continue and remain governed by the Terms of Sale.

Transfer. We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens, and it will not affect your rights.

Third parties. These Terms of Use are between you and us. No one else has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

The whole agreement. These Terms of Use, the Terms of Sale, the Privacy Policy, the Returns and Refunds policy and the Shipping policy together set out everything that applies to your use of the site and to your orders. This does not affect the information we gave you before you placed your order, which forms part of your contract with us.

17. Changes to these terms

We may update, change or replace any part of these Terms of Use by publishing the change on this page.

Changes apply to your use of the site from the moment they are published. Orders already placed remain governed by the version of the Terms of Sale in force when the order was made.

18. Governing law and jurisdiction

These Terms of Use are governed by the law of England and Wales.

This does not deprive you of the protection given to you by the mandatory consumer law of the country where you live. If you live in the United Kingdom, the protections given to you by UK consumer law, including the Consumer Rights Act 2015, continue to apply in full.

You may bring proceedings in respect of these terms in the courts of the country where you live. We will bring proceedings against you only in those courts.
